These Terms of Use ("Terms") govern your access to and use of the Noted iOS application and notedai.io website (collectively, the "Service"), operated by FoundryNet Labs ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms. If you don't agree, don't use the Service.
You must be at least 13 years old to use Noted. By using the Service, you represent that you meet this requirement.
You are responsible for safeguarding your credentials and for any activity that occurs under your account. Notify us at foundrynet@proton.me if you suspect unauthorized access.
Your captures (photos, voice notes, and the structured fields extracted from them) are stored in our hosted database (Supabase) and tied to your account. Captures are private to you — we don't share them with other users or sell them to third parties.
To classify a capture, we send the image or transcript to AI providers (Anthropic Claude and OpenAI) on a request basis. These providers process the content per their published policies and do not train on our API traffic. We don't include your account identity in those requests.
We don't sell your data. We don't run ads. We don't share your captures with anyone outside the infrastructure required to operate the Service (cloud storage, AI classification, payment processing).
You can delete your account at any time from the Settings screen inside the Noted iOS app (tap Delete account and all data). Deletion is permanent: your captures, images, embeddings, and account record are removed from our database. If you'd prefer we delete it for you, email foundrynet@proton.me from the address associated with your account.

The Noted app, branding, and underlying software are owned by FoundryNet Labs. You retain ownership of the content you capture.
The Service is provided "as is" and "as available", without warranties of any kind. Classification is performed by AI models and may be incorrect or incomplete. Don't rely on Noted for legal, medical, financial, or safety-critical decisions.
To the maximum extent permitted by law, FoundryNet Labs will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill arising out of your use of the Service. Our aggregate liability for any claim arising out of these Terms will not exceed the amount you paid us in the twelve months preceding the claim.
We may update these Terms from time to time. If changes are material, we'll notify you in the app or by email. Continued use of the Service after changes take effect means you accept the updated Terms.
We may suspend or terminate your access to the Service if you breach these Terms or if we discontinue the Service. You may stop using the Service at any time by deleting the app and your account.
These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws principles. Any dispute will be resolved exclusively in the state or federal courts located in San Francisco County, California.
